1. Overview & Agreement to Terms

This Terms of Service agreement (“Agreement”) legally governs your access to and use of the e-commerce website located at https://store.briangwalton.com (“Site”), including any related software, subdomains, features, or store services (collectively, the “Services”), operated and owned by Walton International Business Group LLC (“Company”, “we”, “us”, or “our”).

By browsing, visiting, registering an account, subscribing to marketing communications, or completing a product purchase through the Site, you (“User”, “Customer”, or “you”) explicitly acknowledge that you have read, understood, and agreed to be legally bound by all terms, conditions, and policies set forth herein and referenced within this Site. If you do not agree to these terms in their entirety, you are strictly prohibited from accessing or using the Site and Services.

2. Store Operations & Eligibility

By accessing or using the Site, you represent and warrant that you are at least the legal age of majority in your state, province, or country of residence, or that you are of legal age and have granted explicit consent for any minor dependents under your care to access and use the Site.

You further represent and warrant that your access to and conduct on the Site will strictly comply with all applicable local, national, state, and international laws, rules, and regulations. Utilizing our products or Services for any unlawful, fraudulent, or unauthorized purpose—including unauthorized commercial resale or unauthorized distribution—is strictly prohibited.

3. Products, Pricing & Made-to-Order Production

Mountaineers General Store offers items categorized into three distinct product divisions:

  • Garb: Apparel and wearable merchandise crafted using eco-friendly and sustainable materials, such as organic cotton and recycled polyester.
  • Gear: Accessories, drinkware (such as koozies), collectibles, and novelty items.
  • Grooves: Sound recordings in physical formats (including 12″ collector’s vinyl records) and instant digital audio downloads.

Sustainable Made-to-Order Model: To champion environmental sustainability and actively combat overproduction waste, physical products in the Garb and Gear lines are produced on a made-to-order basis. By placing an order, you acknowledge and agree that items are custom-manufactured specifically upon purchase confirmation.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We reserve the right to limit product quantities per order or per customer. All product descriptions and pricing are subject to change at any time without prior notice at our sole discretion. We reserve the me to modify or discontinue any product or service at any time.

4. Digital Products & Intellectual Property License

This section governs all purchases of digital content, audio files, album downloads, and electronic media categorized under “Grooves” or related electronic products.

  • Limited Personal License: Upon payment of the applicable purchase fee for a digital product, the Company grants you a limited, non-exclusive, non-transferable, revocable, personal license to download, store, and play the digital audio file solely for your personal, non-commercial entertainment.
  • Prohibited Uses of Digital Content: You shall not copy, duplicate, broadcast, stream, perform publicly, distribute, lease, sell, modify, alter, edit, create derivative works from, reverse engineer, or commercially exploit any digital download or associated artwork, metadata, or media files without explicit written consent from Walton International Business Group LLC.
  • Non-Refundable Status: Due to the immediate delivery mechanism and intangible nature of digital media, ALL SALES OF DIGITAL DOWNLOADS ARE FINAL AND ABSOLUTELY NON-REFUNDABLE ONCE THE DOWNLOAD LINK OR FILE HAS BEEN GENERATED OR ACCESSED.

5. Payment Gateway & PCI-DSS Compliance

You agree to provide current, complete, and accurate purchase, billing, and account information for all transactions conducted on the Site. You warrant that you are legally authorized to utilize the designated payment card or billing method.

All financial transactions are processed through secure, PCI-DSS (Payment Card Industry Data Security Standard) compliant third-party payment gateways. Walton International Business Group LLC does not store full credit card account numbers or raw cardholder security codes on its servers. We reserve the right to refuse, limit, or cancel any order placed with us, particularly orders that appear, in our sole judgment, to be placed by unauthorized resellers, distributors, or fraudulent entities.

6. Shipping, Delivery & International Orders

Shipping estimates and delivery timeframes provided at checkout are estimates only and do not constitute guaranteed delivery dates. Risk of loss and title for all physical merchandise pass to you upon our delivery of the items to the shipping carrier.

For international orders delivered outside the United States, you are designated as the importer of record and must comply with all laws and regulations of the destination country. International shipments may be subject to import duties, taxes, tariffs, and customs clearance charges levied by local governments once the package arrives. You are solely responsible for paying all such additional import costs; the Company has no control over these levies and cannot predict their exact amounts.

7. Return, Refund & Cancellation Policy

Our return and refund policy reflects our sustainable made-to-order manufacturing framework:

  • 30-Day Defective or Damaged Claim Window: Physical goods containing manufacturing defects, misprints, or shipping damage are eligible for replacement or refund if reported within thirty (30) days from the date of delivery. To initiate a claim, contact customer support with your order number and photographic evidence of the defect.
  • Exclusion of Buyer’s Remorse & Sizing Exchanges: Because products in the Garb and Gear categories are custom manufactured on-demand upon order placement, we do NOT accept returns, exchanges, or order cancellations due to buyer’s remorse, accidental selection, or incorrect sizing choices. Please carefully consult product sizing charts prior to checkout.
  • Exclusion of Digital Downloads: As detailed in Section 4, digital audio downloads (“Grooves”) are strictly non-returnable and non-refundable under any circumstances once delivered.

8. Intellectual Property & Trademark Protection

All content, visual interfaces, graphics, logos, brand names, designs, compilation of data, audio recordings, software, trade dress, and Site elements—including but not limited to “Mountaineer Brand”, “Mountaineers General Store”, “Garb Gear Grooves”, and associated artwork—are the exclusive intellectual property of Walton International Business Group LLC or its content suppliers, protected under United States and international legal copyright, trademark, and trade secret statutes.

Nothing contained on the Site grants any license or right to use any trademark, service mark, or copyrighted work without the explicit prior written authorization of Walton International Business Group LLC.

9. User Content, Feedback & Newsletter Terms

  • User Submissions: If you send or post reviews, creative suggestions, comments, or other materials (“User Content”) to the Company, you grant us a royalty-free, perpetual, irrevocable, worldwide, transferable license to edit, copy, publish, distribute, translate, and use such User Content in any medium without restriction or monetary compensation to you.
  • VIP Club & Newsletter Subscriptions: By subscribing to the Mountaineers VIP Club or email newsletters, you consent to receive periodic promotional, marketing, and operational communications. You may opt out of promotional communications at any time by clicking the “Unsubscribe” link provided in any marketing email footer. Opting out of marketing updates does not alter transactional receipts or order notifications.

10. Prohibited Uses

In addition to other limitations set forth throughout these Terms of Service, you are strictly prohibited from using the Site or its contents:

  • For any unlawful, fraudulent, or deceptive purpose;
  • To solicit others to perform or participate in any unlawful acts;
  • To breach any federal, state, local, or international laws or regulations;
  • To infringe upon or violate our intellectual property rights or the rights of others;
  • To harass, abuse, intimidate, defame, slander, disparage, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • To submit false, misleading, or deceptive information;
  • To upload or transmit viruses, trojans, malware, spyware, or any malicious code;
  • To collect, harvest, or track personal information of other users, or conduct automated data scraping, crawling, or mining;
  • To bypass, disable, or tamper with the security controls or access barriers of the Site.

Violation of any prohibited use may result in immediate termination of your permission to access the Services and potential civil or criminal liability.

11. Disclaimer of Warranties & Limitation of Liability

THE SITE, SERVICES, AND ALL PRODUCTS DELIVERED TO YOU THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WALTON INTERNATIONAL BUSINESS GROUP LLC, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR ACCESS TO OR USE OF THE SITE, SERVICES, OR ANY PRODUCTS PROCURED USING THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY.

12. Indemnification, Governing Law & Dispute Resolution

  • Indemnification: You agree to indemnify, defend, and hold harmless Walton International Business Group LLC, its parent company, subsidiaries, affiliates, officers, directors, agents, contractors, licensors, and employees from any claim, demand, liability, or damages, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service, your misuse of the Site, or your violation of any law or third-party rights.
  • Governing Law: This Agreement and any dispute or transaction arising out of or related to your use of the Site shall be governed by, construed, and enforced in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles.
  • Jurisdiction & Venue: Any legal suit, action, or proceeding arising out of or relating to these Terms of Service or the Services shall be instituted exclusively in the state or federal courts located in Ada County, State of Idaho, USA. You irrevocably submit to the personal jurisdiction and venue of such courts.

13. Severability, Entire Agreement & Contact Information

  • Severability: If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall nevertheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these terms without affecting the validity and enforceability of remaining provisions.
  • Entire Agreement: These Terms of Service, along with any operating rules or privacy policies posted on the Site, constitute the complete and exclusive agreement between you and Walton International Business Group LLC regarding your use of the Services, superseding all prior oral or written communications.
